Section 01

Definitions

“Finnovate”, “we”, “us” — Finnovate Financial Services Pvt. Ltd. and its affiliates, officers, employees, agents, partners, and licensors.

“User”, “Doctor”, “you” — any person who registers for and uses our Services.

“Registered User” — a doctor who has completed sign-up and holds an active, verified account.

“Services” — educational content (courses, videos, podcasts, newsletters, live webinars, community forums, and tools) designed to support doctors with personal finance planning.

“Doctor Registration Number (DRN)” — the official medical registration number issued by the relevant State Medical Council.

“State Medical Council” — the governing body in the doctor’s respective Indian state that registers medical professionals.

“Platform” — the Financial OPD website, mobile-optimised pages, and any associated apps operated by Finnovate.

Section 02

Eligibility — Doctors Only

The Platform is strictly for practising medical professionals. By registering you represent and warrant that:

• You hold a valid medical licence issued by a State Medical Council and recorded with the National Medical Commission (NMC).
• All details you submit are complete, accurate, and current.
• You are at least 18 years of age.

Licence Verification

• At sign-up you must provide your DRN and select your State Medical Council.
• Finnovate will verify your licence against the NMC or the relevant State Medical Council database before activating full account access.
• During verification your account will be in a limited-access state. You will be notified by WhatsApp or email once verification is complete.

Impersonation & False Claims

• Finnovate reserves the right to suspend or terminate any account, withhold certificates, and report suspected impersonation to the NMC, law-enforcement, or other authorities.
• You agree to indemnify Finnovate for any loss, cost, or liability (including legal fees) arising from false representations.

Section 03

Registration & Account Security

To register you must provide your full name, mobile number, email address, Doctor Registration Number, and State Medical Council. All fields are mandatory.

Your account is secured via OTP (one-time password) sent to your registered mobile number. You are responsible for:

• Keeping your login credentials and OTPs confidential.
• All activity that occurs under your account.
• Notifying Finnovate immediately at [email protected] if you suspect any unauthorised access.

Finnovate will never ask for your OTP or password via phone, email, or WhatsApp.

Section 04

Communication Consent

By registering on Financial OPD, you explicitly consent to receive communications from Finnovate Financial Services Pvt. Ltd. through the following channels:

What we send

• Transactional messages: OTPs, account verification, payment receipts — these cannot be opted out of as they are essential to the service.
• Service communications: Course enrolment confirmations, webinar reminders, platform updates.
• Educational content: Finance tips, newsletters, community highlights tailored for doctors.
• Promotional communications: New courses, events, and offers from Finnovate.

Opting out

You may opt out of non-transactional communications at any time by:

• Clicking the “unsubscribe” link in any email.
• Replying STOP to any WhatsApp message.
• Emailing [email protected] with the subject line “Unsubscribe”.

Opting out of promotional communications will not affect your ability to receive essential transactional messages.

Section 05

Community Guidelines

Financial OPD hosts an exclusive peer community for verified doctors. By participating you agree to:

• Be respectful: Treat all members with professional courtesy. Personal attacks, harassment, or discriminatory language will not be tolerated.
• Stay on topic: Discussions should remain relevant to personal finance, financial planning, investments, and related topics for medical professionals.
• No spam or solicitation: Do not promote third-party products, services, or investment schemes without prior written approval from Finnovate.
• No misleading information: Do not share unverified financial claims, fake news, or advice that could harm other members.
• Protect privacy: Do not share other members’ personal or financial information outside the community.
• No impersonation: Do not impersonate other members, financial advisors, or Finnovate staff.

Finnovate reserves the right to remove any content or suspend any member who violates these guidelines, without prior notice.

Section 06

Paid Courses & Pricing

Course Fees

• Certain courses, workshops, and live events carry a fee (“Paid Courses”). Prices are displayed on the course checkout page and quoted in Indian Rupees (INR), exclusive of applicable taxes.
• Full payment is due at the time of enrolment via the payment methods shown on the Platform.

Taxes & Invoices

• GST and any other statutory taxes are additional and will be shown at checkout and on the invoice.
• An electronic tax invoice will be emailed to your registered email address after successful payment.

Refunds & Cancellations

• Digital courses: No refund once course material has been accessed.
• Live webinars / events: Cancel up to 48 hours before the start time for a 100% refund. Cancellations within 48 hours are non-refundable.
• Finnovate-cancelled events: If Finnovate cancels or reschedules a Paid Course, you may opt for a full refund or a free transfer to a future date.

Price Changes

Finnovate may modify course prices or introduce subscription plans. Changes apply prospectively and will not affect payments already made.

Section 07

Acceptable Use

You agree to use the Platform and Services only for lawful purposes and in accordance with these Terms. You must not:

• Violate any applicable law or regulation, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
• Impair the functionality, security, or integrity of the Platform.
• Access content or Services through any method other than the provided interface (including scraping, bots, or automated tools).
• Share, distribute, or resell Platform materials for commercial purposes without prior written consent from Finnovate.
• Upload or transmit viruses, malware, or any other harmful code.
• Attempt to gain unauthorised access to any portion of the Platform or its related systems.

Section 08

Data Collection & Privacy

Finnovate collects and processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable Indian laws.

Data we collect

• Identity data: Full name, Doctor Registration Number, State Medical Council.
• Contact data: Mobile number, email address.
• Usage data: Courses accessed, login history, platform interactions.
• Payment data: Transaction details processed securely via our payment gateway. We do not store card or UPI credentials.
• Communication data: Records of WhatsApp and email communications for quality and compliance purposes.

How we use your data

• To verify your medical credentials and activate your account.
• To deliver the Services you have enrolled in.
• To send transactional and promotional communications (as consented).
• To comply with legal and regulatory obligations.
• To improve the Platform and personalise your experience.

Data retention

We retain your personal data for as long as your account is active or as required by law. You may request deletion of your account and associated data by contacting us at [email protected]. Certain data may be retained longer where required by law or for legitimate business purposes.

Your rights under DPDP Act 2023

• Right to access information about the data we hold about you.
• Right to correction of inaccurate personal data.
• Right to erasure (subject to legal retention requirements).
• Right to withdraw consent for non-essential processing.
• Right to grievance redressal through our Data Protection Officer.

Section 09

Intellectual Property

All content on the Platform — including text, images, videos, podcasts, courses, tools, and software — is protected by applicable intellectual property laws and is owned by Finnovate or its licensors.

You may access and download materials for personal, non-commercial use only. You may not copy, modify, distribute, publicly display, broadcast, or sell any content without prior written consent from Finnovate.

Sharing course recordings or materials with third parties (including on social media or group chats) constitutes a violation of these Terms and may result in account termination and legal action.

Section 10

Disclaimers

Finnovate does not guarantee specific financial outcomes from using its Services. Investment in financial products involves risk, including the possible loss of principal.

The Platform is provided on an “as is” and “as available” basis. Finnovate makes no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.

Section 11

Third-Party Links

The Platform may contain links to third-party websites or services for reference or convenience. Finnovate does not endorse, control, or assume responsibility for the content, products, or services of any third-party website.

Accessing third-party links is at your own risk. We recommend reviewing the privacy policy and terms of any external site you visit.

Section 12

Indemnity

You agree to indemnify, defend, and hold harmless Finnovate, its directors, employees, agents, and partners from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from:

• Your misuse of the Platform or Services.
• Your violation of these Terms.
• Any false, fraudulent, or misleading information you provide, including misrepresentation of medical credentials.
• Your infringement of any third-party rights.
• Violations of applicable law.

Section 13

Limitation of Liability

To the maximum extent permitted by applicable law, Finnovate and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including but not limited to:

• Loss of profits, revenue, or data.
• Financial loss arising from investment decisions made in reliance on Platform content.
• Service interruptions, errors, or security breaches beyond Finnovate’s reasonable control.

In any event, Finnovate’s maximum aggregate liability to you for any claim shall not exceed the total fees paid by you to Finnovate in the twelve (12) months preceding the claim.

Section 14

Force Majeure

Finnovate will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond Finnovate’s reasonable control, including natural disasters, pandemics, government actions, labour disputes, power failures, or disruptions in telecommunications or internet infrastructure.

Section 15

Termination

Finnovate reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if we determine that you have:

• Violated any of these Terms.
• Provided false or misleading information during registration.
• Engaged in conduct harmful to other members or the Platform.

Upon termination, your right to access the Services will cease immediately. You may request an account closure by contacting [email protected]. Fees paid for Paid Courses are non-refundable upon termination for breach.

Section 16

Changes to Terms, Services, or Fees

Finnovate reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Effective Date” at the top of this page.
• Notify you via email or WhatsApp where the change materially affects your rights.

Continued use of the Platform after the updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform and may request account closure.

Section 17

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of thirty (30) days.
